What Constitutes Visitation Rights

In Utah, parents without joint physical custody have the right to visitation, or parent-time, with their children. Under state law, minimum “parent-time” provides that noncustodial parents get visitation with their children every other weekend, every other holiday, half of their children’s winter break and four weeks during the summer.

If parents cannot agree on a visitation schedule, the state has standard schedules that will be used. These schedules vary depending on the child’s age.

There are two types of custody: physical and legal. Physical custody concerns your parenting time. Legal custody governs your decision-making power as a parent. While you may not share physical custody of your child, you may still have joint legal custody. This means you have a voice when decisions regarding your child’s health, education, religion and general welfare are made.
